Terms of Service
Welcome to 107.design. These Terms of Service ("Terms") govern your use of the website at https://107.design (the "Site"), operated by Vlad Bubenko as a sole proprietorship trading as 107.design ("107", "we", "us", "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. About the Site
The Site is a portfolio and studio presence for 107.design. It showcases our work, describes our services, and provides ways to contact us. The Site is hosted in the United States and is directed at a global audience looking for a design and engineering partner. It does not sell products, process payments, or host user accounts.
2. Intellectual Property
a) Our content
All text, images, designs, logos, code, animations, case studies, and other content on the Site that we created — including the 107® mark and the "107.design" name — are the intellectual property of 107.design. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission. Brief excerpts for the purpose of commentary or review (with attribution) are welcome — that's not just fair use, it's flattering.
b) Client trademarks and work
Case studies, screenshots, and descriptions of work for our clients may include trademarks, logos, brand names, or copyrighted materials that belong to those clients. These are shown with permission (or under fair use as portfolio samples) and remain the property of their respective owners. Nothing on this Site grants you a license to use any client trademark or asset.
c) The gated case studies
The password-protected case studies describe client engagements that include internal architecture, revenue numbers, and proprietary details. They are shared with you under a strict trust:
- You may access them for your own evaluation of our work (e.g., before hiring us).
- You may not publish, redistribute, share the passphrase, or quote the confidential details in public — online or offline — without our explicit written consent.
- If you received the passphrase from a client or partner of ours, those confidentiality obligations apply to you too.
3. Portfolio and claims
Case studies and testimonials describe real work we've done. Metrics (e.g., "10M+ learners reached") are based on the data available to us at the time of writing — we report them in good faith, but we don't guarantee their precision for every purpose. Past results are not a guarantee of future outcomes for any engagement.
4. Acceptable use
You agree to use the Site only for lawful purposes and in a way that doesn't harm, degrade, or disrupt it. Specifically, you may not:
- Scrape, crawl, or bulk-download the Site without our permission (AI/LLM bots that respect
robots.txtare welcome — see robots.txt); - Attempt to bypass the passphrase gate on the gated case studies;
- Introduce malware, viruses, or other harmful code;
- Use the Site for any deceptive or fraudulent purpose.
5. Third-party links
The Site may link to third-party websites (e.g., client sites, technology partners). We don't control those sites and aren't responsible for their content, privacy practices, or availability. Your use of any third-party site is at your own risk.
6. Disclaimer of warranties
The Site is provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of bugs or viruses. We reserve the right to take down the Site or change its content at any time without notice.
7. Limitation of liability
To the maximum extent permitted by applicable law, 107.design and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising out of your use of (or inability to use) the Site, even if we've been advised of the possibility of such damages.
Because some jurisdictions (including EU member states) do not allow the exclusion or limitation of liability for certain damages, some of the above limitations may not apply to you. In those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer.
8. Indemnification
You agree to indemnify and hold 107.design harmless from any claims, losses, damages, and expenses (including legal fees) arising from your violation of these Terms, your misuse of the Site, or your infringement of any third-party rights.
9. Governing law and jurisdiction
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. For any dispute arising from these Terms or the Site, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in San Francisco, California, United States.
For EU/EEA/UK consumers: Nothing in these Terms deprives you of the protection of mandatory consumer protection laws in your country of residence. If you are a consumer based in the European Union, the United Kingdom, or another jurisdiction with similar protections, you may also bring proceedings in your local courts. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
10. Changes to these Terms
We may revise these Terms at any time by updating this page. If the changes are material, we'll note it on the homepage for a reasonable period. Continued use of the Site after changes take effect means you accept the new Terms.
